AGENCY DISCLOSURE AND
DIFFERENT TYPES OF AGENCIES

The following information is quoted from the Real Estate Commission disclosure forms used to disclose the various types of agencies used in Colorado. Real estate brokers and salespersons are required to disclose the different types of working relationships available to the general public in a Real Estate transaction. Effective January 15, 2003, Colorado is a Designated Brokerage Agent state.There are two types of agencies and one type of non-agency available in Colorado. The first type of agency is SELLERS AGENT, with duties and loyalties to the seller. The second type is BUYERS AGENT, with duties and loyalties to the buyer. The third type of relationship is the TRANSACTION BROKER, who does not represent either party but is only a middleman for both parties. Other variations occur when selling a listing by the same agent that has the purchaser for that listing.

Discrimination on the sale of any housing because of race, age, sex, color, religion, handicap, familial status, or national origin is prohibited by the Federal Government. According to excerpts from the Department of Veterans Affairs, pamphlet 264, revised August 1992, The Executive Order 11063 banned any discrimination in all federally assisted housing. The "Fair Housing Law", Title VIII of the Civil Right Act of 1968, followed by amending legislation, required positive action taken by Federal agencies to prevent discrimination in all housing. Further, Title VIII protects from the following acts when they are based on discrimination on account of race, color, religion, sex, handicap, familial status, or national origin:

· Refusal to deal in a transaction

· Discriminatory in terms of the sale

· Discriminatory advertising

· False representations that a dwelling is not available

· Blockbusting

· Discrimination in finance practices

· Discrimination in Real Estate services

As long as a purchaser can financially afford to purchase a home, they can purchase the home of their choice anywhere they like. These laws provide every person an equal opportunity to choose suitable housing.
